1. Who we are and how these Terms work

These Terms of Service (“Terms”) govern your access to and use of the learning platform, courses, downloadable resources, tools, job board, community spaces, websites and related services provided by Ad Creative Academy Limited (“Ad Creative Academy”, “we”, “us”, “our”). Company details: Ad Creative Academy Limited, Unit 308, 3/F, Chevalier House, 45–51 Chatham Road South, Kowloon, Hong Kong. Email: team@adcreativeacademy.com.


By accessing or using any part of our services (the “Services”), you agree to these Terms. If you do not agree, do not use the Services.

We may update these Terms from time to time. For material changes, we will notify you by email at least 14 days before changes take effect (or sooner if required for legal/security reasons). The “Effective date” above will show the latest version. Your continued use after changes become effective means you accept the updated Terms.


Age requirement. The Services are for users 18 years or older.


2. What we offer & your license

2.1 Offer

We provide online course content (video lessons, readings), downloadable resources (worksheets, templates, frameworks), quizzes and exams, a capstone assignment and certificate upon successful completion, access to partner software trials/discounts, and a job board. We also host a private Slack community.


2.2 Access term

Access begins immediately upon successful payment and continues for 12 months for the purchased course or bundle, unless otherwise stated.


2.3 Permitted use & seat limits

  • One seat per account. Do not share your login or allow others to access your account.

  • Streaming only for course videos. Downloading, copying, screen-capturing or redistributing course videos or lesson content is prohibited.

  • Downloadable resources. You may download and use our worksheets, templates, frameworks and prompts (the “Resources”) in your own business and to deliver work for your clients, but you may not resell, sublicense, re-publish, or redistribute the Resources or create competing products that substantially reproduce them.

2.4 License to you

Subject to these Terms and timely payment, we grant you a limited, non-exclusive, non-transferable, revocable license to access the Services for your personal learning and professional use as described above. We reserve all other rights.


2.5 Certification

To receive an Ad Creative Academy Certificate, you must complete all required quizzes, pass the final exam, and submit a satisfactory capstone assignment per the rubric. We may update assessment criteria, weighting, or graders to ensure academic standards.


2.6 Changes to the Services

We may modify or discontinue features (e.g., curriculum updates, instructor changes, platform migrations, schedule adjustments). If a material change substantially reduces core access during your term, we’ll provide a reasonable alternative of equivalent value.


3. Accounts & security

You must provide accurate information at signup and keep it updated. You’re responsible for all activity on your account and for safeguarding your credentials. Notify us promptly of any suspected unauthorized use. We may suspend or terminate accounts for violations.


4. Pricing, payments, taxes, refunds

4.1 Payments & processors

Purchases are one-time payments that grant 12 months of access. We accept Stripe and PayPal (including Apple Pay and Google Pay where available). Currency: USD. VAT/GST: not charged by us.


4.2 No subscriptions

There are no recurring subscriptions and nothing to cancel.


4.3 No refunds — important information for EU/UK consumers

All sales are final and non-refundable. Because access begins immediately, EU/UK consumer law may grant a 14-day right of withdrawal unless you consent to immediate performance and acknowledge losing that right. At checkout we require your explicit consent to immediate access and your acknowledgement that you lose the 14-day withdrawal right. If you do not consent, do not complete the purchase.
This clause does not affect any non-excludable statutory rights (e.g., defective digital content remedies required by law).


4.4 Pricing errors & chargebacks

We may cancel orders for pricing/availability errors. You agree not to make fraudulent chargebacks; we may contest improper chargebacks and suspend access.


5. User content, portfolio rights & our license

5.1 Your submissions

You may submit assignments, exam answers, capstone projects, forum posts, and other content (“User Content”). You represent you have all rights to submit it and that it does not infringe others’ rights or violate law.


5.2 License you grant us

By submitting User Content, you grant Ad Creative Academy a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to host, store, display, reproduce, modify, and distribute your User Content for operating the Services and for academic, portfolio, and promotional purposes (e.g., showcasing student work on our website, social media, or sales materials). We will credit you where practical.


5.3 Your portfolio rights

You are encouraged to publicly showcase your projects created in the program (subject to any third-party rights you use, e.g., client assets, music, or fonts).


6. Acceptable use & community standards

You agree not to:

  • copy, record, redistribute, or resell course videos or non-downloadable materials;

  • upload malware, spam, or engage in scraping, automated data collection, or rate-limiting evasion;

  • harass, threaten, or discriminate; post hate speech, explicit content, or unlawful material;

  • dox, leak, or share private cohort materials, exams, or answer keys;

  • promote illegal activities or infringe IP rights;

  • advertise or solicit in community spaces without our written permission.

Enforcement ladder: we may warn → mute → suspend → terminate access to the community and/or platform. No refunds for enforcement actions due to your violations. We may report unlawful conduct to authorities.


7. AI use, academic integrity & third-party tools

We teach and encourage responsible AI use. You must:

  • disclose material AI assistance in assignments where instructed;

  • not submit wholly AI-generated work as your original work unless the assignment explicitly allows it;

  • follow the terms and policies of AI and other third-party tools (e.g., OpenAI/ChatGPT, Midjourney, Anthropic Claude, Adobe, etc.) and obtain your own accounts/licenses;

  • not bypass usage limits, technical protections, or engage in plagiarism or exam misconduct.

Violations may result in academic penalties, certificate denial, and/or account actions under Section 6.


8. Job board & partner offers

The job board and partner software trials/discounts are provided as-is. We do not control third-party postings, offers, or decisions and do not guarantee interviews, employment, or partner benefits. Third-party terms, privacy policies, and eligibility rules apply.


9. Intellectual property

The Services, websites, course content, branding, and all associated IP are owned by us or our licensors. Except for the licenses expressly granted to you, no rights are transferred. You may not use our trademarks, certification badge, or brand assets except as expressly permitted.

Certification badge & assets. If you earn certification, you may use our provided certificate and badge in accordance with any brand guidelines we publish. Do not modify the badge or imply our endorsement of your services.


10. Privacy & communications

Our Privacy Policy and Cookie Policy explain how we collect and use personal data (links will be provided on release). We will send you transactional emails (e.g., receipts, course updates) and, where permitted, marketing emails; you can opt out of marketing at any time. We do not record live calls at this time.


11. Platform & third-party dependencies; availability

We deliver the Services via third parties including LearnWorlds (learning platform) and Slack (community). We do not guarantee uninterrupted availability and are not responsible for outages, changes, or failures of third-party services. Such events may constitute force majeure or be outside our reasonable control. We’ll use reasonable efforts to restore access or provide alternatives.


12. Sanctions, export control & geographic restrictions

You may not use the Services if you are located in, or are an ordinarily resident of, a jurisdiction subject to comprehensive sanctions or if you are on any applicable restricted-party list. We comply with sanctions laws applicable to our Hong Kong entity, including measures implemented under Hong Kong’s United Nations Sanctions Ordinance (Cap. 537), and other applicable international regimes where required. We may restrict or terminate access to comply with such laws.


13. Warranties & disclaimers

The Services are provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. No results are guaranteed. Case studies and examples are illustrative only. We do not provide legal, tax, accounting, financial, or medical advice.


14. Limitation of liability

To the fullest extent permitted by law:

  • We will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill.

  • Our aggregate liability for any claim relating to the Services will not exceed the amount you paid to us for the specific product or course giving rise to the claim.

  • Nothing in these Terms limits liability for fraud, wilful misconduct, or liability that cannot be excluded under applicable law.


Why this cap? Given your one-time purchase model, capping liability at the price paid for the course is standard and proportionate. If you prefer a different cap (e.g., a fixed USD amount), tell us and we’ll adjust.


15. Termination

You may stop using the Services at any time. We may suspend or terminate access (with or without notice) for violations of these Terms, unlawful conduct, or to comply with law. On termination, your license ends and you must stop using the Services. Sections that by nature should survive (e.g., IP, disclaimers, liability limits) will survive.


16. Governing law & dispute resolution (Hong Kong)

These Terms and any non-contractual obligations are governed by the laws of Hong Kong.

  • Consumers: You and we submit to the non-exclusive jurisdiction of the courts of Hong Kong, without affecting any mandatory protections under the consumer laws of your country of residence.

  • Business purchasers (B2B) only: At our election, disputes may be finally resolved by arbitration administered by HKIAC under the HKIAC Administered Arbitration Rules, seated in Hong Kong, with one arbitrator, and proceedings in English.

Class or representative actions are not contemplated under Hong Kong procedure; to the extent any collective mechanism is available in your locale, you agree to individual dispute resolution to the maximum extent permitted by law.


17. Accessibility

We aim to provide an accessible experience and strive to align with WCAG principles where feasible. If you need a reasonable accommodation, contact team@adcreativeacademy.com.


18. Support

Questions or support requests: team@adcreativeacademy.com. We typically respond within 48 business hours (Mon–Fri, Hong Kong time), excluding public holidays.

19. Miscellaneous

  • Entire agreement. These Terms are the entire agreement between you and us regarding the Services.

  • Severability & waiver. If a provision is unenforceable, the remainder stays in effect. No waiver is effective unless in writing.

  • Assignment. You may not assign these Terms without our consent. We may assign them in connection with a merger, sale, or reorganization.

  • Notices. We may notify you by email or through the Services interface. Legal notices to us: team@adcreativeacademy.com (and by post to our registered address).

  • Force majeure. We are not liable for delays or failures caused by events beyond our reasonable control.
